Frequently Asked Questions About Tennessee Estate Planning and Probate

Yes. Your first consultation is free, at our Franklin office, by phone or by video. Bring any existing documents, a rough list of assets and, for an estate, the will and death certificate. We explain what the work involves and what it will take before you decide anything.

Not always. Estates with $50,000 or less in property may qualify for the small estate affidavit, and some real estate can pass by muniment of title. An attorney is most useful when there are creditors, real estate to sell, family disagreement, or the 60-day inventory and TennCare affidavit to manage.

Call as soon as admission is likely. We start with a crisis consultation that reviews income, assets and transfers from the last 60 months. If income is over $2,982 a month, the Qualified Income Trust has to be drafted and funded correctly, so do not gift or retitle anything before that review.

Not always, but have it reviewed. Wills, trusts and powers of attorney signed in another state may still work, while others use wording or signing steps that Tennessee banks, hospitals and courts are not used to. We review what you have and tell you which documents to keep and which to sign again.

Yes. We work with clients across Tennessee by phone and video. Estates are filed with the court that handles probate in the county where the person lived, such as the Williamson County Clerk and Master in Franklin or the Davidson County probate court in Nashville.
