Family Law Mediation in North Carolina

Three people talking at a conference table in a bright office

Most North Carolina family cases settle before trial, and mediation is where that usually happens. A neutral mediator helps you and your spouse work out an agreement you both can accept. You keep control of the outcome instead of handing it to a judge. Sawyer & Associates prepares you for mediation and sits beside you in the room so you don’t agree to something you’ll regret.

What is family mediation?

Mediation is a confidential meeting where a trained, neutral mediator helps separating spouses or parents reach their own agreement. The mediator doesn’t take sides or make decisions. If you reach an agreement, it’s put in writing and can be made binding.

Types of mediation in North Carolina family cases

Custody mediation

In most districts, parents in a contested custody case must attend custody mediation through the court’s Custody Mediation Program before a judge hears the case (N.C.G.S. 50-13.1). These sessions focus only on the children and the parenting schedule. They don’t cover money issues like child support or alimony.

Mediated settlement conferences for property and support

In equitable distribution cases, the court will usually order a mediated settlement conference through the Family Financial Settlement Program. You and your spouse choose a certified mediator, or the court appoints one, and you share the cost. Alimony and child support can be settled in the same session.

Private mediation

You don’t have to wait for a lawsuit. Many couples mediate before anything is filed and use the result to build a separation agreement.

Why mediation works

  • It costs less. One or two days of mediation usually costs far less than a trial.
  • It’s faster. You set the schedule instead of waiting on a court calendar.
  • It’s private. What’s said in mediation is generally confidential and can’t be used in court.
  • You decide. You and your spouse can craft creative solutions a judge couldn’t order.

How we help you prepare

Good mediation starts long before the session. We gather financial records, value assets, run child support numbers and talk through your priorities. In the room, we test each offer against what a judge would likely do, so you know when a deal is fair and when to keep negotiating.
